Why the Government Spin on Property Tax ?

In yesterday’s Irish Independent article it is revealed that registration for the government’s Local Property Tax is currently between 25 and 30% .  This is despite the passing of the deadline for returning the LPT declaration form.

It is still quite difficult to get an accurate handle on the real percentage because no two statements can agree on exactly how many households there are in Ireland.  Figures range from 1.6 to 1.8 million.  Whatever the true figure, it is still a dreadful return and a strong message from the people to the government.  Indeed one year on, a third of the population have still not registered for the original €100 Household charge.

The government naturally prefer the lower figure to make the percentage registered figure look higher.  Of course there is a good reason for this, and it is the same reason we saw the debate in the media last year disputing the numbers who registered for Household charge.  Then the government engaged in a mass media offensive to convince the public that over 50% of the home owners had registered by the deadline, and we are seeing the start of that campaign again.

You see the government continually cites its ‘mandate’ to make these decisions, based on the general election vote (though the fact that FG run the entire country based on 25% of the electorate voting for them is another discussion).  However, if more than 50% of the country simply does not register for the government”s new tax, that mandate reasoning evaporates.  The government would then be forced to resign, although the history of politicians in Ireland resigning is not an honourable one.

So we can see the thinking behind the wall to wall media coverage.  After last year’s problems the government are pulling out all the big guns this time.  The Revenue have been called in and have had their ‘information’ campaign all over the media for many weeks now.  In reality the Revenue’s message has been one of threat and really nothing else.  They refer to people who don’t register as ‘offenders’ and use heavily loaded words to instill fear in normal honest people, and a sense of being unceasingly hunted as criminals.  Indeed the article quotes the government on this theme by saying “Government sources say the rise in household charge payments is down to the fear of Revenue being on their trail”

There are still 3 weeks remaining for people to register for the tax online of course and we predict that in that time the media spin machine and the numbers game will hot up again.  Undoubtedly the government will claim over 50% compliance (at the lower level figures) before the 28th May deadline.  We will of course be seeking our own independent figures as, under the circumstances, it would be foolish to trust a government who has everything to lose to report the figures correctly.

DDI’s stance on this issue is clear.  We are well aware that the government has slashed hundreds of millions from local government budgets over the last 2 years, and have diverted that money to paying unsecured bondholders against the wishes of the people.  This new tax is simply filling that hole.  For that reason we do not agree with this tax and propose that the two issues must be solved together as they are simple cause and effect, and both have been imposed without any recourse to the will of the people.

There is more than one way to stop an unlawful tax of course.  The tax can be, and is being challenged in the courts over the last few months by the first man to be brought to court for not making a declaration This test case was reported in the Sunday Mirror on 5th May 2013.  The established parties naturally all refute that this is even possible, and we can understand why they would say that.  The oddity though is that the minority parties that get themselves directly involved in the campaign protests against the tax seem to be actively coming out against the legal route too.  A route which could offer a definitive and binding legal determination on the government.  Why these parties choose to ignore the courts is a question only they can answer especially as it is common knowledge that they ‘had’ a very large legal fund collected by tax protestors over the last year.  If one were a skeptic one might wonder if they are just another form of controlled opposition to try to limit the effectiveness of the campaign.

In addendum, today at the Public Accounts Committee it has also been revealed that the rate of property tax can be increased by 15% at the start of 2015.  This is despite the government having previously said the tax could not be increased for 3 years.  The revenue also disagree with the government’s original line and say that it was always in the legislation that it could be increased within the first 3 years. Indeed in 2016 the councils will be able to increase it year on year at their own discretion.

We all remember how Enda Kenny’s government sold the Household Charge with spin like  ‘It’s only €2 a week’ or ‘it’s less than a pint a week’.  Well now in 2013 that has risen to an average of €8 per week. In 2015 that will be €9 per week, and in 2016 it is going to be over €10 per week and forever rising to the levels we see in the UK where bills of over €60 per week (€3,000 p.a. equivalent average home) are common.  Have no doubt this is the goal.  Like the boy with the finger in the dyke, if you take out the stopper and let that water trickle through pretty soon the dyke is gone and you will be flooded.

Environment Minister Phil Hogan and some of his departmental advisers clocked up bills of €133,000 jetting around the world – including €800 for a lunch in a Rio de Janeiro restaurant specialising in 'exotic birds and alligator'.

Mr Hogan and his advisers have flown the equivalent of four-and-a-half times around the globe, staying in plush hotels and resting up between flights in airport business lounges, according to documents obtained by the Sunday Independent. As they visited far-off lands in a bid to help save the environment, it has been estimated that the CO2 emissions belched out by the flights are bigger than the entire output of an island with a population of 7,000 people.

Mr Hogan, who is fronting the introduction of the hated property tax, has been out of the country 31 times since becoming Environment Minister two years ago.

His travels for conferences and meetings on behalf of the Government have taken him to Shanghai, Rio de Janeiro, Durban in South Africa and Nairobi in Kenya, as well as New York, Paris and Rome.

"The minister and the department are very aware of the costs incurred due to business conducted abroad. These trips are undertaken as part of the normal business agenda of the department and the size of delegations (which, in the main, comprise officials of the department rather than advisers, as stated) and the costs are kept to an absolute minimum at all times," according to Mr Hogan's department.

"Economy flights are the norm and 95 per cent plus of these trips have been economy class," according to a department spokesman. "Trips abroad are kept to a minimum and the minister only travels abroad on official business. The need to keep carbon emissions to a minimum is always a priority."

Phil Hogan has 14 days to lodge a defence in High Court Case against him

We received the following in relation to ongoing case against Phil Hogan and co.

“We note that you/ye have failed refused or neglected to lodge a Defence to the High Court in
relation to Case Number: 2012/12340P. As a courtesy, we will extend to you/ye a final fourteen
(14) days from the date of this letter to lodge a Defence and proffer us and our client with copy
of same. Should you fail to lodge your Defence within the fourteen (14) days stipulated, we will
proceed to Judgement in default, and enforcement proceedings against you/ye will ensue.”

Septic Lies from a Septic Government!

The two articles below demonstrate as clearly as possible that this government does not know
HOW TO LIE in a credible way.
The first article from the Irish Independent (February 19th) reports that 120,000 homeowners
did NOT register their septic tanks. The second article from the  Irish Examiner (February 20th) reports that 90,000 homeowners did not register their septic tanks.

THIS IS A WHOLE OF 30,000 HOMES! Is Hogan seriously trying  to tell us that 30,000 people registered in the
middle of the night?! Moreover, if you return to the original articles about septic tank
registration in 2012, you will note in all the papers that there were 447,000 septic tanks said
to be in the country. A DIFFERENCE OF 53,000 SEPTIC TANKS!


It is an exact re-run of the Household Charge fraud. At the beginning of the campaign, 1.8
million houses were due to register, once council houses and housing associations were
removed from the equation. Almost overnight, this dropped inexplicably to 1.6 million. What
happened to 200,000 houses in 24 hours.

500,000 homeowners face septic tank inspections from July

UP TO 500,000 homeowners can expect their septic tank to be inspected from next July.
The Environmental Protection Agency (EPA) has announced details of a national inspection
plan with 120,000 homeowners who refused to register their tanks among the first to be
inspected.


Just 1,000 inspections will take place in the first year of the new regime, but the number is
likely to increase.
The inspection regime follows a ruling from the European Court of Justice last December that
Ireland was not doing enough to protect groundwater.

The EPA said the aim of the inspection regime was to ensure that systems were working
effectively and that risks to the environment were eliminated.
Septic tanks process waste-water from houses, including water from washing machines and
toilets, and if the water is not treated effectively it can pollute groundwater and pose risks to
human health.


“There are around 500,000 homes in Ireland with domestic waste water treatment systems –
our goal is to have every single one of those working effectively,” EPA director Gerard
O’Leary said.


“If treatment systems are not working properly they can pose significant risks to people’s
health and to the environment. The National Inspection Plan initially focuses on a campaign
to advise, educate and help people to operate and maintain their systems. We want to
increase the chances of treatment systems passing inspections as this will deliver the best
outcome for public health and the environment. Inspections will begin later this year and will
be concentrated in areas in need of greatest protection.”
Inspections will be targeted in areas at high-risk, including bathing and drinking water
sources and pearl mussel beds.


Homeowners will be notified of an inspection at least ten days in advance by their local
authority.
The inspections will focus on determining whether or not the treatment system is working
properly, and will include checking to see if the system is registered, is not leaking and if it
has been properly maintained.


The EPA said owners of domestic waste water treatment systems who have registered their
system, and maintain it, do not need to take further action

The 90,000 householders yet to register their septic tank will be in the frontline of a new
inspections regime announced yesterday by the Environmental Protection Agency.

The EPA said its plan for domestic waste water systems was about safeguarding both public health and the environment.
Latest figures show that while about 500,000 homes in Ireland have domestic waste water treatment systems, 18% missed the Feb 1 deadline for registering a septic tank.


As part of the inspections scheme, certain areas will be prioritised, starting with those who have not registered.
Any household being inspected will be notified 10 days in advance.
The EPA said it was keen to prioritise homes where drinking water might be affected.


Gerard O’Leary, EPA director, said: “There are around 500,000 homes in Ireland with domestic waste water treatment systems — our goal is to have every single one of those working effectively.


“If treatment systems are not working properly, they can pose significant risks to people’s health and to the environment.
“The national inspection plan initially focuses on a campaign to advise, educate, and help people to operate and maintain their systems.”
Anyone who missed the deadline for registering their septic tank will be unable to draw down any grants and face covering the costs themselves.
Environment Minister Phil Hogan said that householders whose systems are being maintained and are not causing pollution, had nothing to fear from the implementation of the inspection plan.


Mr Hogan also labelled opposition parties “reckless” for their “irresponsible behaviour” in opposing the septic tank charges.
The EPA also welcomed the announcement Ireland was now compliant with the Court of Justice judgment in Case C-188/08, in which the European Commission had ruled against Ireland on the grounds that domestic waste waters were being discharged through septic tanks in the countryside.

A 70-year-old Co Mayo man challenging the validity of the Household Charge has initiated proceedings in the High Court.

Peter Anthony Keegan from Belclare, Westport has named ministers Phil Hogan, Alan Shatter and Michael Noonan among those he says are in breach of the European Convention of Human Rights.

Employees at Mayo County Council and the Local Government Management Agency were also named.

He says the defendants wilfully neglected and disregarded a demand for information and answers about what he claims is an unlawfully concocted local government household charge.

Mr Keegan says he has been given no recourse to a defence on the matter, which he claims is unlawful, unconstitutional and a human rights violation.

He was one of a number of property owners before Westport District Court in relation to non-payment of the household charge.

He was accompanied by his sister Mary and son Brendan. A number of other cases have since been resolved.

Judge Conal Gibbons adjourned the rest of the cases to 7 March pending the outcome of the High Court proceedings.

There is growing unease about the Government’s calculation of yield from the property tax. Not only was there no obvious cognizance taken of the existing €160m household charge or the €70 Non Principal Private Residence in Budget 2013 workings – you’d expect the  non-continuance of these two taxes to be shown alongside the €250m to be raised from the property tax in 2013 and the €500m in 2014. After all, if there is not to be any household charge or NPPR in 2014, then you would need deduct €230m from the €500m and in 2013, deduct €160m from the €250m.

There doesn’t seem to be any great foundation to the estimate of yield for property tax, which is strange given the expert report was on Minister for the Environment, Community and Local Government Phil Hogan’s desk since June 2012.

Seems like the Government has committed to a measure but will only know how much it will bring in, at the end of 2013. Kinda like buying a scratch card and only afterwards finding out if you have won anything.

This upcoming case has significance for those in front of a Judge for “Non-Declaration” or “Non-Payment” of the Household Charge. A useful reference is “it might be Lawfully and or Constitutionally Unsound or Unsafe for the Court to proceed, until this matter and case with Phil Hogan & Co. has been concluded in the High Court. In other words NOBODY on the Island could be safely prosecuted for “Non-Declaration” or “Non-Payment” until this case is settled.”

A second document has come into this writer’s possession which now makes it inevitable that Phil Hogan & his fellow sleeveens will face a grilling in the High Court early in the New Year. Hogan and his mob are about to be charged with imposing a fraudulent Act upon the Sovereign People of Ireland.

Some people have been asking how the serving of such Notices should be so powerful. Firstly, the FFS people behind this document have re-discovered their own immense personal power and are putting it to good use. Each one of us possesses these same vast powers but they’ve lain dormant through centuries of deceit, brainwashing, and manipulation. Now, more and more of us are waking up to our true spiritual nature and enormous abilities.

Secondly, the serving of these Notices is a legal procedure known as the Honour/Dishonour process. It is a private administrative process to elicit agreement and to negate the position of an adversary.

Those who ignore a formal Notice, or who do not respond to it appropriately, are held to be in agreement with everything the Notice asserts. (Therefore, you ignore Notices from your bank or debt collector or whomever at your peril!)

Looks like we’re set for a very interesting New Year!

A short time ago, this writer received a copy of a confidential formal Notice sent yesterday to Minister Phil Hogan demanding answers to a number of hard hitting questions about his controversial Household Charge Act. The Notice was copied to Noonan, Shatter, senior judges, and others.

Hogan was given 72 hours to answer “in a clear, concise and unambiguous manner” a series of pointed and well-thought-out questions. If Hogan doesn’t answer each and every question completely and satisfactorily he will be forced to answer to the Irish People in the High Court early in the New Year.

The Notice served on Hogan arises from a summons served on an individual (whom we shall not name in the interest of privacy). This individual has been summonsed to appear in court for failing to make a declaration regarding the Household Charge.

This lawful challenge to the Powers That Be is incredible news! At last, some Irish people have found the cojones to stand up for themselves. It’s now time for us all to row in behind the originators of this powerful document and show all these colluders in government and the judiciary that it is they who are subservient to us – not the other way round. It is time the masters took over their own house and put the uppity servants in their place.

The Notice was served on Hogan by Fitzpatrick Financial Solutions (FFS) of Portlaoise and we say fair play to them and wish them well when they take on Hogan in the High Court. We can see that FFS mean business by the depth and detail of the questions posed. Their language is also forthright and assertive.

In dealing with Hogan’s Department of  the Environment, FFS accuses the Minister and his staff “of a criminal conspiracy and cover up.”

FFS warns Hogan: “If you do not answer ALL of the questions in the manner prescribed, we will have no issue standing the €157 required, for our client to take you and your cohorts into the High Court and force you to answer publically [sic] for your duplicity.”

FFS asks the Minister a very pertinent question that goes to the core of this traitorous government and the last one: “How is ‘the Act’ of the ‘Household Charge Act 2011′ not the equivalent to dictatorship, bondage and slavery?”
